General information
This data privacy statement, which refers exclusively to data collected as part of the online application process, is to inform you about how your personal data that is collected as part of the online application process is handled at our end.

Personal data collected as part of the application process
Personal data means any information concerning the personal or material circumstances of an identified or identifiable individual. This includes information such as, for example, your name, address, telephone number and date of birth, but also data relating to your specific career etc. by reference to which a specific individual can be identified with reasonable effort. However, information which cannot be (in)directly associated with your real-life identity is not personal data.

Fundamentals and purposes of processing personal data collected from application documents and during the application process
If you apply to us electronically, i.e. via e-mail or using our online form, we will collect and process your personal data for the purpose of executing the application process and preparing contracts.
By submitting an application via our recruitment website, you express your interest in taking up work with us. In this context, you transmit personal data, which we will use and store exclusively for the purpose of your job search / application process.
In particular, the following data is collected during this process:
  • name (first and last names)
  • e-mail address
  • phone number (optional)
  • channel through which you found us
Furthermore, you can choose to upload expressive documents such as a cover letter, your CV and reference letters. These may contain additional personal data such as date of birth, address etc.
Only authorized HR staff and/or staff involved in the application process have access to your data.
The personal data is stored, as a rule, exclusively for the purpose of filling the vacancy for which you have applied.
Your data will be stored for a period of 180 days after the application process has been concluded. This is usually done to fulfill legal requirements and/or defending ourselves against any claims arising from legal provisions. After this period, we are obligated to delete or anonymize your data. In case of anonymization, the data will only be available to us in the form of so-called metadata, without any direct personal reference, for statistical analysis (for example, share of male and/or female applicants, number of applications per specified period of time etc.).
Furthermore, we reserve the right to store your data for 180 days after the application process has been concluded for the purpose of adding it to our Talent Pool in order to identify any other vacancies that may be of interest to you. This includes, for example, applications for apprenticeships or internships. By accepting the data privacy statement, you consent to any further storage of your data as well as its inclusion in our Talent Pool.
Should you be offered and accept a position with us during the application process, we will store the personal data collected as part of the application process for at least the duration of your employment.

Disclosure of data to third parties
Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. This database is operated by Personio GmbH, which offers a human resource and applicant management software solution (https://www.personio.com/legal-notice/). In this context, Personio is our processor under article 28 of the GDPR. In this case, the processing is based on an agreement for the processing of orders between us as the controller and Personio.

Rights of data subjects
If we as the controller process personal data, you as the data subject have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and the purpose of the processing, in particular the right of access (article 15 of the GDPR) and the rights to rectification (article 16 of the GDPR), erasure (article 17 of the GDPR), restriction of processing (article 18 of the GDPR), and data portability (article 20 of the GDPR), as well as the right to object (article 21 of the GDPR). If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR.
To assert your rights as a data subject in relation to the data processed during this online application process, please refer to our Data Protection Officer (see item 2).

Concluding provisions
We reserve the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the application process or other processes. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.

2. which sources and categories of data do we use?

We process personal data that we receive from you in connection with your application. This is the data that you make available to us by transmitting the application documents and your details in job interviews.

We also visit profiles of applicants on professionally oriented social networks, if such are available. We do not visit profiles in private social networks.

It is also possible for us to receive data from recruiters to whom you have provided your application documents and who you propose to us as candidates for a position. If references from previous employers are to be requested, this will be discussed separately with the applicant.

Relevant personal data are e.g. name, address and other contact data, birthday, academic and professional background, references, certificates etc..


3. why do we process your data (purpose of processing) and on what legal basis?

We process personal data in accordance with the provisions of the European Data Protection Basic Regulation (DSGVO) and the Federal Data Protection Act (BDSG), processing takes place exclusively if it is permitted by law or if we have received your consent for data processing.


3.1 Processing of your data for the purpose of filling vacancies (Article 6 para. 1b DSGVO)

Data processing is carried out for the purpose of selecting personnel to fill vacant positions. These are pre-contractual measures which serve to initiate employment contracts.


3.2 Processing of your data on the basis of legitimate interests within the scope of weighing up interests (Article 6 para. 1f DSGVO)

If necessary, we process your data beyond the actual initiation or fulfillment of the contract to protect the legitimate interests of us or third parties - provided that your interests would not outweigh those of protection - such as in the following cases:

Background research of applicants for positions with special compliance relevance: We have a legitimate interest in researching whether an applicant for certain fields of activity may be shortlisted on the basis of his or her details.  
Improvement of our application process and surveys on applicant satisfaction: We use findings from surveys or individual interviews on the subject of applicant satisfaction to determine improvement potential and to make the application process more effective. Where possible, we process your data in pseudonymised form, i.e. in such a way that you cannot be identified directly.
Defence against and assertion of legal claims: In addition, we save data of applicants in order to be able to defend ourselves against asserted claims, for example from the AGG, if necessary. We disclose personal data to public authorities and courts if this is necessary in order to defend ourselves in legal disputes or to assert legal claims.

3.3 Processing of your data on the basis of your consent (Article 6 para. 1a DSGVO)

We also process your personal data if and to the extent that you have consented to data processing for certain purposes pursuant to Art. 6 para. 1 a DSGVO. The areas for which data processing is carried out within the scope of this are determined by the respective consent.
Any consent given may be revoked at any time. This also applies to the revocation of declarations of consent given to us before the DSGVO came into force, i.e. before 25 May 2018.

Please note that the revocation will only take effect in the future. Processing that took place before the revocation is not affected by this.

3.4 Processing of your data based on legal requirements (Article 6 para. 1c DSGVO)

We process your personal data even if we are obliged to do so by law. This includes, for example, feedback to the Agentur für Arbeit as well as information to public offices, authorities and courts, insofar as we are obliged to do so.


4. who receives my data?

We treat the fact that you apply to us as well as your personal data confidentially. Within our company, only those departments and employees who need your data to fulfil the above-mentioned purposes will have access to it. These are usually employees of the personnel department and the specialist department within which the position is to be filled, e.g. the manager in whose team the position is located.

With regard to the transfer of data to recipients outside our company, it should be noted that we only pass on information about you if this is required by law, if you have consented to this or if we are authorised to provide information.
Under these conditions, recipients of personal data may be, for example, public bodies and institutions (e.g. authorities) if there is a legal or official obligation.  

In addition, we cooperate with service providers who support us. We only transmit your personal data to our services and cooperation partners if there is a legal basis for doing so. These are service providers in the following areas:

Personnel consultants and recruiters
headhunters
Service provider for checking the applicant qualification

Other data recipients may be those entities for which you have given us your consent to the transfer of data or to which we are authorised to transfer personal data on the basis of a weighing of interests.

5 How long will my data be stored?

If necessary, we process and store your personal data as long as it is necessary for the realisation of the processing purposes and/or for the fulfilment of statutory duties of supervision.  

If you have not been selected for the position for which you applied, we will delete your data for six months from the date of rejection.

If an employment contract is concluded between you and us, your application documents will be included in the personnel file and stored for at least the duration of the employment relationship and any subsequent storage obligations.

If and to the extent that you have given us your consent to data processing for specific purposes, such as for example to continue to store your data and to contact you in order to offer you further vacancies, the processing time shall be determined by the purpose of the consent given.

Finally, the storage period is also assessed according to the statutory limitation periods, which, for example, according to §§ 195 ff. of the German Civil Code (BGB) can generally be three years, but in certain cases also up to thirty years.


6. are data transferred to a third country or to an international organisation?

Data will only be transferred to third countries (states outside the European Economic Area - EEA) if this is necessary for the execution of your orders, is required by law or you have given us your consent. Access to data in these cases will only take place if either a Commission adequacy decision exists for the respective country, if we have agreed with the service providers the standard contractual clauses provided by the EU Commission for these cases or if the respective company has drawn up its own internal binding data protection regulations which have been recognised by the data protection supervisory authorities. We will inform you separately about the details if required by law.


7 What data protection rights do I have?

Each person concerned has
The right of access under Article 15 DSGVO,
the right to rectification under Article 16 DSGVO,
the right to cancellation under Article 17 DSGVO,
the right to limit the processing pursuant to Article 18 DSGVO
as well as the right to data transfer under Article 20 DSGVO.

The restrictions in §§ 34 and 35 BDSG apply to the right to information and the right to cancellation.

In addition, there is a right of appeal to a data protection supervisory authority (Article 77 DSGVO in conjunction with § 19 BDSG).

You can revoke your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us prior to the application of the Basic Data Protection Regulation, i.e. before 25 May 2018. Please note that the revocation will only take effect in the future. Processing that took place before the revocation is not affected by this.

8. is there an obligation to provide data?

An application to our company is voluntary. However, it is necessary to provide your personal data regarding your previous professional and/or educational background, your qualifications, your abilities and personal details as well as your contact details so that we can find out whether you as an applicant are suitable for the vacant position and whether we can make a corresponding selection of personnel. Without the provision of this data by you as the applicant, no personnel selection can take place in the application process. Consequently, failure to provide personal data means that you cannot be considered when filling the vacancy as a candidate.


9. To what extent is there automated decision-making in individual cases?

We do not use fully automated decision making in accordance with Article 22 DSGVO. Should we use these procedures in individual cases, we will inform you separately about this and about your rights in this regard, insofar as this is prescribed by law.


10. To what extent is my data used for scoring purposes?

As a matter of principle, we do not use profiling in accordance with Article 22 DSGVO. Should we use this procedure in individual cases, we will inform you of this separately if this is required by law.

Information about your right of objection
pursuant to Article 21 of the Basic Data Protection Regulation (DSGVO)

You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you on the basis of Article 6 paragraph 1e DSGVO (data processing in the public interest) and Article 6 paragraph 1f DSGVO (data processing on the basis of a weighing of interests); this also applies to profiling based on this provision within the meaning of Article 4 No. 4 DSGVO.

If you file an objection, we will no longer process your personal data for these purposes unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

You are entitled - without restriction - to object to any type of processing for direct marketing purposes pursuant to Art. 21 (2) and (3) DSGVO. If you object to the processing for purposes of direct marketing, we will no longer process your personal data for these purposes.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Error logs

As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected.
